Overview and scope
Motto Mortgage AFFINITY independently owns and operates a mortgage brokerage office under a franchise agreement with Motto Franchising, LLC. We retain the services of mortgage professionals and loan originators who are employees or independent contractors.
This Notice does not apply to the privacy practices of Motto Franchising, LLC or Motto Franchising, LLC’s other independent franchisees and their respective mortgage professionals, loan officers and loan originators or to any websites or mobile applications they may independently operate. Please consult with Motto Franchising, LLC and each respective franchisee to learn more about their privacy practices.
This Notice also does not apply to:
- Personal information collected by third parties, such as when you visit a third-party website, or interact with online advertisements. Please take a moment to review the privacy policies of third-party sites before you disclose your Personal Information to them, as we disclaim responsibility for their actions with regard to your information; or
- Our personal information and privacy practices with respect to job applicants, employees, and other Motto Mortgage AFFINITY personnel.
What is personal information?
“Personal Information” as used in this Notice, is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. It does not include information that has been anonymized, aggregated, or de-identified in such a manner and maintained in such a form that it is not capable of being associated with or reasonably linked to an individual. Personal information also does not include information which is publicly available.

Information you provide
In connection with our provision of the Services, we collect Personal Information that you voluntarily provide to us. The types of personal information you may provide to us and when you may provide it include:

When you create an account: Through the Online Services you may register for an account to, for example, apply for a mortgage loan, and access and use certain services we may offer (either directly or from an affiliate on our behalf), access mortgage or brokerage-related resources, and for other features we may add from time to time ("Account"). When you register for an Account, we collect your first and last name, email address, phone number, username, and password. We may also collect additional Personal Information from you in the course of providing our services, for example, information pertaining to your loan application such as social security number, credit history and financial information.

When you contact us: When you contact us with questions about the Services, our business, or other matters, we will use any personal information you provide, including, for example, your name, geographic location, email address, and phone number, as well as other information you may choose to provide in the contact form, to resolve your request or answer your questions, or to provide additional information related to your inquiry.
Information we automatically collect through our Online Services
As is true with many websites, the Online Services automatically collect certain information about your device, your browser, and your activity.
In particular, when you visit or interact with the Online Services, our servers will record information that is sent by your browser or device as well as information about your use of the Online Services. This information can include your device’s IP address, information about the browser and operating system you are using, unique device identifiers, pages that you navigate to and links that you click, and other information about the ways you interact with the Online Services. Depending on your device’s settings, we may also collect information about your device’s location.

Web Beacons: Pages of the Online Services may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users and gather other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Our third-party partners may also use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Online Services.
In particular, we use third-party analytics providers that may deploy cookies and other similar technologies on the Online Services to analyze traffic to the Online Services and understand the usage of the Online Services. We use Google Analytics, a web analytics tools that may set cookies in your web browser, for example, to help us understand how visitors engage with the Online Services. The information our third-party partners collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services and use the information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used.

Mobile Application Opt-Out: You have the ability to control whether you see interest-based advertisements on your mobile device(s) in the ways described below.

Please note that you will need to opt out separately on all of your browsers and devices, as each opt-out will apply only to the specific browser or device from which you opt out. Information received from third parties
We may receive personal information about you from third parties that supplements the information we collect directly from you and/or through automated means. Examples of such third parties include:
- Information we receive from a consumer reporting agency. Examples of information from consumer reporting agencies include your credit score, credit reports and other information relating to your creditworthiness.
- From employers and others to verify information you have given to us on a loan application. Examples of information provided by employers and others include verifications of employment, income or deposits.
- From lenders regarding applications you make for credit. Examples of this type of information include decisions on an application; conditions imposed on approvals; and disclosures of loan terms.

- To send you marketing and promotional materials, including newsletters and other promotional communications related to mortgage, real estate, and/or other topics that we think may interest you, including information about us and our related entities, advertisers, sponsors, or other business partners (details on how to exercise your choices with respect to marketing and promotional materials and communications can be found in the “Your Choices And Legal Rights” section below);

- To send you updates via text regarding the Services or to contact you via calls to your mobile phone regarding our products and services;

Electronic communications: If you no longer want to receive marketing-related texts or emails from us, you may opt out via the unsubscribe link included in such texts or emails. Please note that if you opt out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with the Services.

Your legal rights

The Online Services are not intended or directed to children under the age of 18, and we do not knowingly collect Personal Information from children under the age of 18.
